In a press release today by the Third Judicial Prosecuting Attorney Henry Boyce, convicted murderer Billy Dale Green, 59 years old formerly of Warm Springs lost an appeal in the Arkansas Supreme Court. Green and his attorneys filed an appeal based on what is know as the Rule 37 Motion claiming ineffective assistance of counsel during his May 2012 trial.
Green is serving life without parole for his conviction in the Elliot family murders where Carl Elliot, wife Lisa Elliot, daughter Felicia and son Gregory were all killed in 1998. Billy Green and son Chad Green are both serving life sentences without parole.
Prosecuting Attorney Boyce stated this is just the latest in what he describes as an “Odyssey of legal battles, twist and turns†that has been going on for 12 years now. Boyce went on to say that Billy Green and his son Chad had been on the loose for 5 years prior to his taking office, 6 months after Boyce took office the 3rd Judicial District began prosecution and was able to take them off the streets and now they will spend the rest of their lives in prison.
